What is the promotion about?

ABB is rewarding its customers, both itself and through its distributor network, with gift cards for purchasing its products above a certain value. The Promotion is being run by ABB on behalf of itself and its distributors.

a. How to enter?

  • The Promotion commences on 15 October 2020 and concludes on 25December 2020 at midnight UAE time (“Term”).
  • Customers must purchase ABB goods to the following values in cumulative transactions across the Term in order to qualify for a gift card from YouGotaGift.com (“Gift voucher”).
  • Entry will be automatic for all customers that place orders to the values noted above.
  • Customers may enter the Promotion only once.
  • Customers must have a valid Tax Registration Number to enter the promotion.
  • Any special projects/price agreements is excluded from this promotion.

b. How to win?

  • Prizes mentioned in above clause will be allocated in March 2021.
  • The allocation will be undertaken by ABB. Each winner will be notified by ac all to the phone number noted on their customer account and will be followed up with an email to the CEO/GM and copied to the finance team, at the addressed noted on their customer account.
  • The decision regarding the winners will be made by ABB and this decision is final and ABB will not enter into correspondence regarding the conduct of the Promotion or the result of the Promotion.

c. Prizes

  • There will be a maximum of 1 Gift Cards per customer.
  • Winners should seek independent financial advice about any tax implications that may arise from winning a Gift Card.

d. No liability

  • These Terms may be changed, varied and modified by ABB at their sole and absolute discretion at any time. Such variation, changes, cancellation, termination, withdrawal or suspension will be notified in any manner as ABB deems fit.
  • In the case of the intervention of any outside act, agent or event which prevents or significantly hinders ABB’s ability to proceed with the Promotion on the dates and in the manner described in these Terms, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, ABB may in its absolute discretion cancel the Promotion and recommence it from the start on the same conditions. In this case, all entries will be considered to be invalid and must be re-entered in order to be considered for the recommenced Promotion.
  • By participating in the Promotion, each customer agrees that:
  1. They represent only themselves and no other person;
  2. They are liable for any and all uses that may be made by them of the Gift Card, including any decision to provide them to any third party;
  3. They will not use the Gift Card and/or Promotion for any purpose that is unlawful or prohibited by these Terms.
  • Each customer acknowledges that ABB and their associated companies will not, to the fullest extent permissible by the applicable laws, be liable in any way whatsoever in respect of any of the following:
  1. Lost, delayed, misdirected, intercepted, undelivered, rejected, blocked or deleted notifications regarding the Promotion;
  2. Virus or other corruption, technical or mechanical error or failure, human error, negligence or unauthorized human intervention in any part of the Promotion or the operation or administration of the Promotion; or
  3. Any action, proceeding, judgment, liability, loss, injury, claim or damage(including, but not limited to, incidental, punitive, consequential, special, director indirect damages or losses, loss of profits, loss of business, loss of business opportunity, economic loss), expense, death and personal injury incurred or suffered by any participant or any other person which may be caused, directly or indirectly, in whole or in part, from any participation in the Promotion or from the Customer’s use of the Gift Card.
  • Neither ABB, its distributors, nor any associated company assumes any responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries, and reserves the right to take any action that may be available.
  • If for any reason this Promotion is not capable of running as planned due to causes including but not limited to tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of ABB which corrupt or affect the administration security, fairness, integrity or proper conduct of this Promotion, ABB reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the Promotion.
  • Notwithstanding any of the above, ABB reserve the right to:
  1. Discontinue the Promotion at any time (including at any time during the Promotion); or
  2. Disqualify any Customer from becoming a winner who is not eligible or does not comply with these Terms.

e. Details

If any of the provisions of these Terms becomes or is invalid, illegal or unenforceable in any respect under the laws of UAE, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired and such invalid, illegal or unenforceable provisions shall be deemed severed from these Terms and ABB shall be entitled to replace such severed provisions with such other provisions as it may deem fit.6.2. The Promotion and these Terms will be governed by the federal laws of UAE as applied in the Emirate of Dubai and the parties agree that any disputes will be exclusively resolved by the Dubai Courts.
